1. INTRODUCTION

British Action Academy Terms of Service. This is a live document and could change periodically. It is your responsibility to check the latest version and read accordingly. You can see the latest edit date at the bottom of the terms.

2. PRIVACY POLICY

We respect the privacy of our users. For details please see our Privacy Policy. By using our Service, you consent to our collection and use of personal data as outlined.

3. ACCESS AND USE OF THE WARRIOR MASTERCLASS ONLINE

The Warrior Masterclass Online Service is solely for your personal and non-commercial use. With the purchase of this product, you will have a limited, non-exclusive, non-transferable licence to access the Warrior Masterclass Online content and view the course. This ongoing limited licence does not mean that any right, title or interest shall be transferred to you. This licence does not cover you to use the Service for the public. We hold the right to revoke your licence at any time under our sole discretion. Under these circumstances, you must destroy all content and materials that you have obtained through this Service which have been made in accordance with the terms and conditions outlined.

Purchase of the Warrior Masterclass Online does not constitute the creation of a contract and therefore the British Action Academy Limited reserves the right to decline a purchase for any reason whatsoever. Purchasing the Warrior Masterclass Online constitutes your acceptance of our Terms & Conditions of trading. All purchases must be made via the Warrior Masterclass Online website, we have no affiliation with other third parties.

To purchase the Warrior Masterclass Online, you will be required to register with us upon purchasing the product. This information must be accurate and up to date. You must be over 18 to purchase this product, however, parents may purchase this product for minors with their consent given.

You may never use another's account, and you may not provide another person with the username and password to access your account. You should maintain control over all of the devices that are used to access the Service. If you fail to maintain control of a device, other users may access the Service through your account and may be able to access certain details from your account information. You are fully responsible for any and all activities that occur under your password or account, and it is your responsibility to ensure that your password remains confidential and secure. It is imperative that you inform us of any suspicious activity relating to your account or within your use of the Service. We will not take responsibility for any loss or damage for any lack of compliance to these terms.

The British Action Academy holds the right to limit the use of the Service until any issues, such as any suspicious activity or multiple login attempts, have been resolved. We hold the right to modify, discontinue, temporarily or permanently suspend the Service with and without notice. We will not be liable to you or to any third party for any modification, suspension or discontinuance of the Service.

You agree that the British Action Academy has no responsibility or liability for the deletion or failure to store any data or other content maintained or uploaded by the Service. You acknowledge that the British Action Academy reserves the right to terminate accounts that are inactive for an extended period of time. You further acknowledge that the British Action Academy reserves the right to change these general practices and limits at any time, in its sole discretion, with or without notice.

Please note, once you download and view the product, you are agreeing to waive the 14 days cooling off period as this is a digital product and does not sit within this category.

4. VAT

Prices quoted include VAT at rates applicable on the day of purchase.

5. INSTALMENTS

Instalments are available for the Warrior Masterclass Online, through our payment gateway using third-party companies. To use these, you will need to agree to their terms & conditions, which are outside of ours.

6. CANCELLATION

After purchase, if you are not satisfied with the product, you have 48 hours to request a refund. After this period - this will not be possible.

7. TRAINING COURSE PHYSICALITY & RESTRICTIONS

All British Action Academy Training Courses involve medium to high levels of physicality and are therefore subject to restrictions. These include (but are not limited to) age (minimum 18 years or below with parental/guardian consent) and physical and medical restrictions.

We measure appropriate fitness by stating that if you can successfully complete a circuit-training class without your fitness being too compromised, the physicality of our courses should be appropriate for you. It is the purchaser’s responsibility to ensure that the online course is appropriate for them and to be sure that the restrictions are not prohibitive. We are very clear about the activities of the online course listed on our website, however, if you are unsure of the suitability/physicality of the product, please email us at info@warriormasterclassonline.com and we will be happy to advise you.

It is important to be in good physical shape with no injuries or illnesses which may hinder your learning.

8. DATA PROTECTION

British Action Academy Limited maintains strict security measures in order to protect any personal information. This includes following certain procedures, for example encrypting data on our websites, in order to ensure compliance with all applicable legal requirements.

We do not sell or disclose your personal information to other companies without your prior consent. We do not sell mailing lists to third parties. British Action Academy Limited is fully PCI Compliant.

9. THIRD PARTIES AND RE-SALE

A person who is not recorded as the account holder of the Warrior Masterclass Online with British Action Academy Limited has no right under the Contracts (Rights of Third Parties Act 1999) to enforce any terms and conditions of a purchase.

An online course account which has been resold by any method (for example, through internet auction sites) without our prior consent will be invalid and British Action Academy Limited will not be under any obligation to provide a service.

10. COPYRIGHT

All course content is fully copyrighted to British Action Academy Limited. All course names and branding is trademarked to British Action Academy Limited. On undertaking a course with the British Action Academy you agree not to copy/replicate any part of the course including but not limited to; course content from presentations, course design/structure, instructor demonstration videos, course names, branding etc. for commercial purposes.

British Action Academy Limited takes the protection of its training content and branding extremely seriously and should a breach of copyright be noticed, British Action Academy Limited reserves the right to seek legal action against the individual/company.

If the individual is a current student, British Action Academy Limited reserves the right to remove their Warrior Masterclass online account with immediate effect.

You acknowledge and agree that the Warrior Masterclass Online may contain content or features that are protected by copyright, patent, trademark, trade secret or other proprietary rights and laws. Except as expressly authorised by the British Action Academy, you agree not to modify, copy, frame, scrape, rent, lease, loan, sell, distribute or create derivative works based on the Service or the Service Content, in whole or in part, except that the foregoing does not apply to your own User Content.

11. LIABILITY

By purchasing the Warrior Masterclass you agree to waive and release, indemnify, hold harmless and forever discharge the: BRITISH ACTION ACADEMY and its agents, employees, officers, directors, affiliates, successors and assigns, of and from any and all claims, demands, debts, contracts, expenses, causes of action, lawsuits, damages and liabilities of every kind and nature, whether known or unknown, in law or equity, that you ever had or may have, arising from or in any way related to your participation in any of the events or activities conducted by, on the premises of, or for the benefit of the BRITISH ACTION ACADEMY provided that this waiver of liability does not apply to any acts of gross negligence, or intentional, willful or wanton misconduct.

You understand that the activities in which you will participate are inherently dangerous and may cause injury; minor, serious or grievous, including bodily injury, damage to personal property and/or death. On behalf of yourself, your heirs, assigns, administrators, executors and next of kin, you waive all claims for damages, injuries and death sustained to you or your property, that you may have against the aforementioned released party to such activity, including claims in tort, contract, equity or otherwise.

You acknowledge, agree, and represent that you understand the nature of SCREEN ACTION RELATED activities and that you are in good health, and in proper physical and mental condition to participate in such activities. You fully accept the below Health & Fitness Terms and Conditions related to SCREEN ACTION RELATED activities:

- You are over the age of 18 (or have parental consent to partake in the online course)

- You are in good general health

- You are in good physical & mental health

- You have no injuries that will hinder your participation in any screen action related activities

This WAIVER AND RELEASE contains the entire agreement between the parties, and supersedes any prior written or oral agreements between them concerning the subject matter of this WAIVER AND RELEASE. The provisions of this WAIVER AND RELEASE may be waived, altered, amended or repealed, in whole or in part, only upon the prior written consent of all parties.

The provision of this WAIVER AND RELEASE will continue in full force and effect even after the termination of the activities conducted by, or for the benefit of the BRITISH ACTION ACADEMY, whether by agreement, by operation of law, or otherwise.

You also agree that if you are a teacher and/or owner of a similar course/training organisation or have the intention to set up similar courses to the British Action Academy, you will not copy or replicate any British Action Academy branding, course contents both written and practical. Should the British Action Academy find any replication of its courses, they reserve the right to remove the participant off the BAA training course with immediate effect and seek legal copyright infringement action.

By purchasing the course, you confirm you have read, understood and fully agreed to the terms of this WAIVER AND RELEASE. You understand by purchasing the course that you have given up considerable future legal rights and agree to any terms and conditions laid out in the document. You have purchased and agreed to these terms freely, voluntarily, under no duress or threat of duress, without inducement, promise or guarantee being communicated to you.

12. WARRANTY

Your use of the Warrior Masterclass Online platform is at your own risk, the service is as available and we expressly disclaim any warranties of any kind, whether express or implied or statutory, including but not limited to the implied warranties of sale.

We make no warranty that:

- The service will be as expected or meet your requirements.

- The service will be uninterrupted.

- The service will be error free.

- The results based on your own training from the platform will be accurate to the given chapters.

- The service will be timely or secure.

- The quality of the product or materials purchased and obtained by you via recommendation by the service will meet your expectations.

- The service will be reliable.

We always aim to strive for the best, but sometimes limitations online do limit our intentions, so please bear the above in mind.
